Agreement
By creating an account or using the EZ Fill apps, websites, or services (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. These Terms are a binding agreement between you and EZFILL LLC ("EZ Fill," "we," "us").
What EZ Fill is (and isn't)
EZ Fill is a software platform that helps Venues (RV parks, campgrounds, gas stations, convenience stores, and hardware/feed stores) manage propane ordering, scheduling, payments, delivery coordination, and marketing. EZ Fill does not supply, deliver, or install propane. Propane is provided by the Venue's servicing propane supplier under a separate agreement between the supplier and the Venue and/or Guest. EZ Fill facilitates payment and scheduling but is not a party to the supply of propane and is not responsible for the propane product, its delivery, or on-site service.
Eligibility & accounts
You must be at least 18 years old and provide accurate information. You are responsible for your account credentials and for activity under your account. Venues and suppliers are subject to additional role-based terms in their respective agreements.
Payments
- Payments are processed by Stripe; by paying, you agree to Stripe's terms. EZ Fill does not store full card details.
- Prices are set by the Venue and/or supplier and shown before purchase. Applicable taxes and fees may apply, and an EZ Fill platform fee may be included per the Venue's plan.
- Prebuy / stored value: where offered, prebuy locks a price for a period, and unused amounts convert to a dollar credit per the program terms.
- Refunds & disputes: refund eligibility depends on the Venue's and supplier's policy and applicable law; contact us at admin@myezfillapp.com to resolve a billing issue. Chargebacks and disputes are handled per Stripe's process and applicable law.
- Because propane is a physical good, purchases are made through Stripe and are not subject to Apple or Google in-app-purchase requirements.
Communications & text messaging
With your consent, EZ Fill and your Venue may send you transactional and (separately) marketing texts and emails. Consent to marketing is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out of texts or HELP for help. See our Privacy Policy for details.
Acceptable use
Don't misuse the Service. You agree not to engage in unlawful, harmful, infringing, or fraudulent activity; interfere with the operation or security of the Service; or attempt unauthorized access. We may suspend or terminate accounts that violate these Terms.
Safety & compliance
EZ Fill's tools are built around propane-safety guidance (including references to NFPA 58) and support Venues in maintaining their compliance posture. EZ Fill does not certify regulatory compliance and does not assume the Venue's or supplier's safety, regulatory, or NFPA 58 obligations. Propane handling, delivery, and installation must be performed by qualified personnel in accordance with applicable law.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. EZ Fill does not warrant the propane product or its supply, delivery, or installation, which are the supplier's responsibility.
Limitation of liability
To the fullest extent permitted by law, EZ Fill and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for propane product, service, or delivery matters. Our total liability for any claim relating to the Service is limited to the amount of EZ Fill platform fees you paid in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless EZ Fill from claims arising out of your misuse of the Service or your violation of these Terms, to the extent permitted by law.
Changes to the Service or Terms
We may modify the Service or these Terms. Material changes will be communicated as required, and your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law & disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Arizona, unless applicable law provides otherwise.
